Shannons Prancing Horse Competition Terms and Conditions
PARTICIPATION
1. This competition ("Competition") is conducted by Shannons Limited (“the Promoter”) of Level 18 Suncorp Centre, 36 Wickham Terrace, Brisbane, Queensland 4000.
2. Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
3. The Competition is only open to individuals who: (i) are residents of Australia aged at least 30 years and no older than 75 years as at time of entry; and (ii) are not employees of the Promoter or any of its related corporations or any of the agencies associated with the Competition; and (iii) are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee; and (iv) hold a valid full driver’s licence (meaning not a P-plate licence) and have gained at least 3 years’ practical driving experience ("Eligible Entrant").
4. The Competition is made up of five (5) competitions (“Competitions”). The entry periods (“Entry Periods”) and draw dates and times for these Competitions are specified in the table below. Except as otherwise stated, all times are Melbourne time.

5. Except as otherwise indicated, all amounts stated in these conditions are stated in Australian dollars.
ENTRY
6. To enter one or more of the Competitions, Eligible Entrants must during the relevant Entry Period, use a compatible browser to visit www.shannons.com.au ("Competition Website") and follow the directions to sign up to the ‘Shannons Club’, create their profile and add at least one vehicle to their ‘Garage’ (including vehicle image and description). The Eligible Entrant must provide all details required by the Promoter.
7. An Eligible Entrant can only sign up to the ‘Shannons Club’ once. Entries are deemed received at the time of receipt by the Promoter in its promotional database and not at the time of transmission by the entrant. An Eligible Entrant can enter one or more of the five Competitions, depending on the date they register for the Shannons Club. For example, if an Eligible Entrant registers on 16/1/2012, during Comp 1’s Entry Period, they will be included in Comp 1’s draw, and in each subsequent Comp draw (in this example, Comp 2 to Comp 5). An Eligible Entrant cannot win more than one Prize in this Promotion, which means that a Winner will be removed from subsequent Competitions’ draws if they win a preceding draw. Should an entrant sign up to the Shannons Club during an earlier Entry Period, then cancel their membership, then re-apply for membership, only their first entry will be eligible. Similarly, if an entrant signs up to the Shannons Club using more than one identity (whether deliberately or otherwise), the Promoter reserves the right to declare all but the first entry valid and void subsequent entry attempts.
8. Only entries received from Eligible Entrants during the relevant Entry Period will be accepted. Entries will be deemed received at the time that the Promoter is satisfied that the relevant requirements under condition 6 have been met and not at the time of submission by the Eligible Entrant. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or delays or failures in any telecommunications service or equipment.
9. The Promoter may, in its absolute discretion, declare any or all entries made by an Eligible Entrant invalid if the Eligible Entrant tampers with the entry process, benefits from such tampering or submits an entry that is illegible, incomplete or not in accordance with these conditions.
10. Eligible Entrants must submit their internet entries manually. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
11. There is no cost for entering the Competition but when entering via the internet an internet connection and usage rates may apply. Eligible Entrants should obtain details of such costs from their service providers.
DRAWS AND PRIZES
12. The draws will be held at 5th Finger Pty Ltd, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000. Each draw is based on random chance within the relevant pool of Eligible Entrants. This is not a game of skill.
13. The first valid entry drawn during each of the Competitions’ draws will win the Prize (“Prize” or collectively “Prizes”) (“Winner” or collectively, “Winners”). The Prize consists of:
A Prancing Horse ‘Overnight Escape’ package for two. Drive a collection of different Ferraris over the course of two days, with the inclusion of day-spa massage treatments, fine dining and an overnight stay for two at a four-star boutique New South Wales (“NSW”) south-coast hotel.
If the Winner resides outside of NSW, the Prize includes two (2) adult return economy class airfares from the winner’s nearest capital city to Sydney. Both persons must travel together on the same dates and routing. A Winner who resides outside of NSW will additionally receive one (1) night twin share accommodation of the Promoter’s choice in Sydney, NSW.
The Promoter will pay the $220 per person (second person only if driving and travelling with the Winner) to reduce the maximum ‘at fault’ vehicle property insurance excess to $5,000. The Promoter disclaims that this $5,000 accident excess cannot be lowered further and the Winner should consider this before taking up the Prize.
The Prize supplier (Prancing Horse Drive Experiences Pty Ltd) imposes restrictions on permitted drivers and passengers. The Winner and their companion, individually, must not weight more than 120kg and must not be taller than 198 cm (6 feet 5 inches) and cannot be more than 24 weeks pregnant. The Winner’s companion must be at least 15 years of age. See also condition 21. If requested in writing along and any reasonably required information, the Promoter will permit a Winner to assign their right to participate in the Prize if they do not meet the Prize supplier’s minimum restrictions.
14. For the purposes of condition 13, "capital city" means: Melbourne, Brisbane, Adelaide, Canberra, Hobart, Darwin or Perth.
15. Flights may not be changed once tickets have been arranged by the Promoter or its agent.
PROVISIONS APPLICABLE TO THE PRIZE GENERALLY
16. The total value of the Prizes is up to $24,600 including GST (based on the Winner and a second person flying from Perth).
17. The Prizes are valued as at 23/11/2011. The Promoter takes no responsibility for any variations in the Prizes’ value.
18. All components of the Prize must be taken together as a single trip, to coincide with the Prancing Horse ‘Overnight Escape’ package. The Prize must be taken within 1 year of it being won.
19. Redemption of Ferrari Drive component of the Prize is subject to additional terms and conditions set by the Prize supplier (for both the Winner and their companion) which are available at www.prancinghorse.com.au
20. The Prize does not (except as expressly stated) include travel costs to and from the points of departure, excess baggage, any additional meals and drinks, transfer costs, taxes, levies and charges, passports, insurance, medical or health related services, additional accommodation, spending money, extension of stay, additional passengers, tours and other ancillary costs (excluding airline and flight associated taxes and charges). These are the responsibility of the Prize Winner and their companion.
21. The Prize cannot be exchanged for other travel to other destinations. The Prize Winner is responsible for any amendment fees issued by travel providers once a flight or accommodation booking has been confirmed.
22. Flights and accommodation are subject to booking and availability and confirmation by the Promoter’s travel supplier at the time of booking. All bookings are subject to the travel supplier's booking conditions.
23. The Prize Winner and their travelling companion are responsible for ensuring that they have all necessary documents to travel to the relevant destination (including photographic identification).
24. If the Prize (or part of the Prize) is unavailable for any reason, the Promoter may, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by the Prize Winner or any other party if the Prize (or part of the Prize) is unavailable for any reason.
25. Subject to condition 13 the Prize is non-transferable, non-refundable, non-exchangeable, non-replaceable, and non-redeemable for cash.
WINNERS OF THE PRIZE
26. The Prize Winner will be notified by an email which will be sent to the e-mail address provided by them in their entry.
27. The Prize notification will state the Prize that has been won and will include instructions as to how the Prize Winner is to claim the Prize and establish their entitlement to it. The Prize will only be awarded following any Winner validation and verification that the Promoter requires in its sole discretion.
28. The name of the Winner of each Prize will be published in The Australian on the following dates:

29. The name of each Prize Winner will be published on the Promoter’s website (www.shannons.com.au/club) within 7 days of the Prize being won (including if the Prize is won under any redraw under condition 32), for a period of at least 1 week.
30. Subject, where relevant, to any directions given under the laws regulating the Competition, if the Prize is: (i) not claimed by the Prize Winner or the Promoter has been unable to successfully notify the Prize Winner within 3 months of the draw for the Prize; (ii) forfeited for any reason; or (iii) the Prize Winner is determined by the Promoter to be ineligible in accordance with condition 29, the Prize will be awarded to another Eligible Entrant in a redraw for the Prize. Any such redraw will be made from the pool of entries comprising the entries that were originally eligible to win the Prize within the relevant Entry Period. Redraws, if required, will take place at the following times for the respective Competitions: Comp 1 - 17 April 2012; Comp 2 - 22 June 2012: Comp 3 - 20 July 2012; Comp 4 - 10 August 2012; Comp 5 - 7 September 2012. Any redraws will take place at 5th Finger Pty Ltd, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000. If there is a redraw, the name of the Winner of the redraw will be published in The Australian on the following dates:

A redraw Prize Winner will be notified in the same manner as explained in conditions 26 and 27.
GENERAL
31. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to provide an alternative travel prize (including an alternative destination at an alternative date as specified by the Promoter) to the same value as the original Prize or to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
32. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any delay in delivery, or failure of safe delivery of or participation in the Prize.
33. All of the Promoter's decisions are final and no correspondence will be entered into.
34. The Prize Winner accepts the Prize at his or her own risk. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant and/or their companion and/or their permitted assign(s) in connection with the Competition or Prize, including without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. The Promoter may request that the Prize Winner and/or their companion and/or their permitted assign(s) sign and return a deed of release to this effect as a condition of the Prize being awarded. If a requested person under this condition 34 fails to sign and return such release, the Prize Winner may forfeit the Prize.
35. The Winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without compensation, financial or otherwise, for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
PRIVACY AND MARKETING CONSENT AND DISCLOSURE
36. Eligible Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise the Prizes Winners and, subject to conditions 36, 37 and 38, may be used to market its products to the Eligible Entrant. The personal information of the Prize Winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, Prize suppliers and deliverers, and to regulatory authorities. The Promoter will disclose the Prize Winner's first initial, surname, suburb and State of residence to The Australian newspaper, who will publish these details. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win the Prize. All personal information is handled in accordance with the Promoter’s Privacy Policy available online at www.shannons.com.au/terms
37. All entries become the property of the Promoter and will be entered into a database. Information resulting from the Eligible Entrant’s entry and participation in a promotion is used by the Promoter and its agencies associated with the Competition for the determination of the Prize Winners. Information about Eligible Entrants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of carrying out planning and product development. By applying or participating in the Competition, Eligible Entrants consent to these uses and disclosures of their information.
38. By entering or participating in the Competition, the Eligible Entrant agrees to receive emails from the Promoter in relation to the administration of the Competition.
39. Eligible Entrants will automatically be entered into the Promoter's marketing program. Eligible Entrants agree to receive mail, telephone calls, emails, SMSs and other electronic messages, including those containing marketing or promotional material, sent by the Promoter under the marketing program. Eligible Entrants may unsubscribe from the Promoters marketing program at any time using information contained on the mail or electronic message.
